Terms of Service
These terms govern use of Continuum, operated by TO BE COMPLETED (TO BE COMPLETED, registration TO BE COMPLETED). By creating an account you agree to them.
1. What Continuum is
Continuum is a workspace for running sales and customer-onboarding relationships: shared buyer portals, mutual action plans, documents, meeting records and engagement insight. It is provided as a hosted service, accessed through a browser.
2. Accounts and organisations
- You must give accurate details when you sign up, and you are responsible for what happens under your account.
- Keep your password to yourself. Tell us promptly if you think someone else has access to your account.
- Each organisation has an owner, who can invite and remove members, change roles, transfer ownership and delete the organisation.
- You must be old enough to enter into a contract in your country, and you must not use Continuum on behalf of anyone who has told you not to.
3. Your data stays yours
Everything you put into Continuum remains yours. We claim no ownership of it. We process it only to provide the service, as described in our privacy policy. You can export all of it at any time from Settings, and you can delete it permanently.
You are responsible for having the right to put that data into Continuum in the first place — including any personal data about your own customers and their staff, and any obligation you have to tell them about it.
4. Acceptable use
You agree not to:
- Break the law, or infringe anyone's rights, using the service.
- Upload malware, or content you have no right to share.
- Attempt to access another organisation's data, or probe, scan or test the security of the service without written permission.
- Interfere with the service's operation, or place an unreasonable load on it — including through automated access.
- Resell or white-label the service without our written agreement.
We may suspend an account that is doing any of these, and will tell you why where we reasonably can.
5. AI features
Continuum can analyse meeting transcripts and deal content to propose summaries, action items and updates. These are suggestions, and a person must approve one before anything changes. AI output can be wrong or incomplete. You are responsible for reviewing it before acting on it, and you should not treat it as legal, financial or professional advice.
6. Availability
We work to keep Continuum available, but we do not promise uninterrupted service. Maintenance, third-party outages and faults happen. Unless we have separately agreed a service level with you in writing, the service is provided on an "as available" basis.
7. Backups
We take regular backups, and you can export your own data at any time. We strongly recommend keeping your own copy of anything you cannot afford to lose. Our backups are a recovery measure for us, not a guarantee to you.
8. Fees
Where a paid plan applies, the price, billing period and what is included are as agreed when you subscribe. Fees are exclusive of VAT unless stated otherwise. Where the service is currently provided free of charge, we may introduce fees on reasonable notice, and you may stop using the service before they take effect.
9. Ending the agreement
- You may stop using Continuum and delete your organisation at any time.
- We may end this agreement on reasonable notice, or immediately for a serious or repeated breach of these terms.
- Export your data before you delete an organisation. Deletion is permanent and we cannot recover it afterwards.
10. Liability
Nothing here limits liability that cannot be limited by law — including for death or personal injury caused by negligence, or for fraud. Subject to that, and to the extent the law allows: we are not liable for indirect or consequential loss, lost profits, lost business or lost data; and our total liability in any twelve-month period is limited to the fees you paid us in that period, or €100 where the service was provided free of charge.
11. Changes to these terms
We may update these terms. If a change materially affects you, we will tell account holders before it takes effect. Continuing to use the service after that means you accept the updated terms.
12. Governing law
These terms are governed by the law of the Netherlands, and the courts there have exclusive jurisdiction — except that if you are a consumer, you keep the protection of the mandatory law of the country you live in.
